This a preversion a new theme. I publish it to have your advices and your suggestions to make a great theme

have i just messed up the install or is anyone else getting this? Also a few icons are a bit too much like a mac but overall best theme i have seen for a while.

A Simple Translucent white Gnome Panel
and a green window bar looks much nicer than your theme i think.

Personally, I love this theme. It compliments Linux Mint perfectly, and it's really clean and looks great. The fact that the title-bar (at least with the GTK theme, not too keen on the Emerald one) blends seamlessly into the application window is perhaps the main reason I use this theme - it's incredibly attractive. The widgets, also, are spot-on and blends perfectly with the theme.
My criticism? The icons need a lot of work (there's a lot of sizing problems) and the buttons on a window-list in the panel could be improved (I, personally, don't like the outline on inactive icons - but I think that's due to the engine rather than the theme, so I can't complain. I know setting my own background fixed it for me.)
Remember, don't let the bastards run you down. Their comments have no meaning or worth as they haven't stated at all why they don't like the theme.
