If you take a look at licensing terms of source photo at http://www.flickr.com/photos/trinity-of-one/18913858/, you can see it's cc-by-nc-nd 2.0 licensed. The "nd" part stands for "No derivs", i.e. copyright holder doesn't allow anyone to build upon its work. So you deriving from that photo means you're infringing his copyright. Yeah, I know, -nc and -nd licences suck, but that's what author decided to use. I suggest to you to look for Free Culture licencsed works (http://freedomdefined.org/Definition), i.e. cc-by, and cc-by-sa.
